Effective as of: 1 April 2026.
1. Definitions and pricing
- Service Provider: M-BIT, computer services craft, owner Mario Ivandić, Zagreb, Croatia, OIB: 33812893661.
- Client: Any natural or legal person ordering services.
- Standard hourly rate: 50 € per hour. (Note: The Provider is not in the VAT system.)
- Software license: The right to use ready-made M-BIT software (e.g. WHMCS modules).
2. Software license sales and support
- By purchasing a license, the Client acquires the right to use a specific version of the software.
- Each license includes 12 months of support and access to all new versions (updates) of the software.
- Support includes fixing critical bugs and basic installation assistance via email.
3. Renewal of support and updates (maintenance)
- Upon expiration of the initial 12-month period, the Client may optionally purchase an annual renewal of support and updates.
- Without an active subscription, the Client loses the right to download new versions, including updates required for compatibility with third-party systems (e.g. new WHMCS versions).
- If the subscription is not renewed within 30 days of expiration, M-BIT may require the purchase of a new license instead of a renewal.
4. Deadlines and project approval (custom development)
- M-BIT commits to meeting agreed deadlines, provided the Client delivers necessary materials on time.
- Upon completion, the Client has 8 days to test the project and submit correction requests.
- If no feedback is received within 8 days, the project is considered approved and completed.
5. Payment terms
- Software licenses: 100% upfront payment is required.
- Custom projects: Amounts up to 2,000 € require 100% upfront payment. Amounts above 2,000 € can be paid via a 50:50 model.
- International bank transfers incur a 10.00 € fee.
6. Digital content and right of withdrawal
- Pursuant to consumer protection laws, the right to a 14-day refund for digital content expires immediately once the delivery has started (e.g. by sending a license key or providing a download link).
7. Intellectual property
- Licenses: M-BIT retains all copyrights to the software. The Client may not decompile or resell the code.
- Custom projects: The Client acquires ownership of graphics and text after full payment, while M-BIT retains ownership of the source code with a usage license granted to the Client.
8. Limitation of liability
- M-BIT is liable for damages only in cases of intent or gross negligence.
- M-BIT is not responsible for losses caused by incompatibility with future third-party system updates if the Client does not have an active update subscription.
9. Governing law and jurisdiction
- These terms are governed by the laws of the Republic of Croatia. All disputes shall be settled before the competent court in Zagreb.
